China National Heavy Duty Truck and Weichai Power Co., Ltd. have finally closed their old father and son's grudge. The former recently withdrew its request for invalidation of some of the latter’s patent rights.
Weichai Power (000338, SZ) announced on Monday that it received the "Notice of Insolvency Case Closure" issued by the Patent Reexamination Board of the State Intellectual Property Office of the People's Republic of China.
The notice states that China National Heavy Duty Truck submitted to the National Patent Reexamination Committee on November 13 the withdrawal of the declared ZL200320121039.6 (diesel engine oil and gas separator) and ZL200320121422.1 (diesel crankshaft front oil seal system) owned by Weichai Power, and ZL200520124550.0 (Whird-spindle grooved crankshaft flanges) and ZL200520125023.1 (for diesel first camshaft bushings) Written declaration of patent invalidation requests.
Weichai Power stated in response to the withdrawal request from China National Heavy Duty Truck that according to the provisions of Article 71 of the "Implementation Rules of the Patent Law of the People's Republic of China", CNHTC applied to the Patent Reexamination Board of the State to terminate the case of invalidation of the said patent right by the company. The company has the above patent rights legally and effectively.

China National Heavy Duty Truck submitted a request to the Patent Reexamination Board of the State Patent Office to declare the invalid application of Weichai Power Patent on November 6, 2007. At that time, Weichai Power accused China National Heavy Duty Truck of infringing its own diesel patent rights, which made CNHTC, which was preparing to list in Hong Kong, feel greatly angry.
According to the data, Weichai Power was once a subsidiary of China National Heavy Duty Truck, but Weichai Power went on its own listing in Hong Kong in March 2004 and wanted to establish its own door. At the beginning of 2005, China National Heavy Duty Truck Co., Ltd. wanted to use its stake in Weichai Power to be listed in Hong Kong as a whole. The "Father and Son" contradiction immediately became public. In August 2005, Weichai invested in the acquisition of Hunan Torch and indirectly controlled Shaanxi Heavy Duty Truck, marking that it began to build its own heavy-duty automotive industry chain. In January 2006, Sinotruk stopped purchasing engines from Weichai Power and the relationship between the two parties was completely broken. On March 20, 2006, Shandong State-owned Assets Supervision and Administration Commission issued a document to lift the equity relationship between the two companies.
